1. Terms and conditions

Pocketwifi.com.hk (the "Company") and (the "Customer') hereby agree to the following Terms and Conditions ("Terms and Conditions") with respect to the products and services offered by pocketwifi.com.hk to the Customer of the wireless communication device and peripheral Equipment (the "Equipment"), including, but not limited to, wireless devices, SIM cards, data cards, user guides, chargers, adapters, and related or additional services (the "Services") which are described herein or included in any agreement between the Company and the Customer for the products and/or services ("Agreement").

2. Privacy Policy

The Company considers the protection of Customers' privacy as fundamental to our Company's business and treats paramount importance. Our Company collects Customers' personal information to the extent necessary to provide telecommunication services, sales, promotion, registration, shipment, collection and management, and may not be used for any other purpose other than the above-mentioned purposes.

3. Use of Equipment

A.  Customers must use the pocket Wi-Fi Equipment with careful and proper manner in their selected destination or in the listed regions only. Unlimited or limited data plans are formulated by the Company and listed explicitly on the website.

B.  The Customer is not allowed to perform Video Up/Downloads, Video Steaming, play Online gaming, make Video Calls or download any big volume data or files. The context performances will see as offending against the Fair Usage Policy. The Customer is required to bear all call costs, responsibility and 100% of administrative fines and compensation to the Company if voice call are being used on the pocket Wi-Fi Equipment.

C.  In some countries, a Fair Use Policy maybe in place to comply with the business practices of the local internet service provider (the local in-country wireless network carrier or operator). If a FUP is in place, it may limit the transfer of a specific amount of data over a period of time. Internet service providers commonly apply a cap on the amount of wireless data when an individual user has exceeded a certain amount of data within a specified time period (say 400-500mb/day), which can result in a throttle down (slow down) of the connection speed that without prior notice or compensation.

D.  Some countries provide only limited data service per day, the Company will indicate the amount of data provide of such pocket wifi or related products in the Customer’s invoice. Remarkably, additional charge will be imposed for cases that exceeded the limit of the data provide.

E.  Customers must NOT turn on the pocket wifi outside of the designated service area/agreed service area in order to avoid any roaming charges. If Customers have chosen limited data service product, they must be aware of the auto update function or wifi sharing matters. Carelessly doing so may lead an overuse unwittingly. This will result an additional charges for the overuse by deducting the deposit/down payment or charging with a separate invoice.

F. Our network specification for downlink of 4G network (most of them with 40Mbps theoretically), which is only available to designated locations with the use of a specific or a compatible CAT 9 device for optimal condition. Actual speeds that customers experience are less than the specifications and will be affected by the device used, locations, network conditions and other extraneous factors.

G. The actual speed that you experience will be considerably less than the network specifications and may be affected by internet conditions, server speeds, network conditions, coverage, locations, the device used, hardware, software, usage levels and other factors.

4. The application form and Contract

A.  Customers should return the completed application forms and return them directly via the Company designated agent or/ by the Company Internet. Once the online application data is received, auto-reply by e-mail will be followed by the Company. Remarkably, rental order contract of pocket Wi-Fi, designated service providers will be selected by the Company, is yet to be confirmed officially until payment is duly settled. Products are being pre-set and the assigned rental Equipment cannot be changed after the order is confirmed.

B.  After the completion of the application in accordance with the formalities ordained by the Company, an agent designated by the Company or the Customer service dept. will start processing the application until full payment is received as confirmation.

C.  Contract is confirmed upon receipt of full payment

D.  Full amount of the deposit/down payment will be refunded to the Customer upon return of all Equipment to the Company in good condition at the end of the contract period.

E.  Full amount of rental charge and deposit/down payment will be refunded to the customer if the Equipments ordered are not available in stock or due to unforeseen circumstances that the Company is not able to provide the requested rental Equipment to the customer. No further claim by the Customer will be given.

F.  Deposit/down payment will be deducted if Equipments are found damage, loss, being stolen, or data overused. The Company will impose additional charges in separate invoice if the amount of exceeded data goes beyond the deposit/down payment.

5. Equipment Delivery

A.  The customer must state the delivery method. The Company will contact the customer for the re-arrangement of the delivery if the Company is not able to comply with the original requested delivery method. The Company will bear all cost for this re-arrangement.

B.  If there is no indication of the delivery method by customer, the Company assumes that customer will pick up the device at the Company counter. The pickup counter address will be Unit A, 8th Floor, Ka Nin Wah Commercial Building, 423-425 Hennessy Road, Causeway Bay, Hong Kong.

C.   The Customer should return the device to our counter in accordance to the order form, thus 6pm (18:00) of the following return date. The Customer may be liable to further rental charges if the Equipment is not returned to the Company by 6pm the following day of return date as penalty. All the returned Equipment is accepted in writing by pocketwifi.com.hk to ensure those returned Equipments are in good and acceptable condition. Extra Equipment rental charges will be calculated as full days only (24 hours) and not based on fractional days.

6. Rental Period

A.  The number of days between the Departure Date and Return Date. The Customer will pay the daily charges from the Departure Date (the date in which the Customer departs) until the Return Date (the day when the Customer returns) for all of the Equipment specified in the Terms and Conditions. The maximum rental period is for 30 days. Special arrangement can be made for rental period exceeding 30 days.

B.  If the Customer encounters any difficulty in using the Service while at their destination, the Customer must immediately notify pocketwifi.com.hk within the Rental Period in order to be entitled for any possible refund or discount to the Charge. Any refund or discount to the Charge is solely at pocketwifi.com.hk discretion. No refund or discount will be entertained if the Customer informs the Company after his/her returns to Hong Kong.

C.  Our pocket wifi or related devises are with good coverage basically. However, different countries have their unique service quality, coverage ability or characteristic (We are relied on our oversea supplier but not upon our control or command of systems and services). This happens especially when Customers are in remote areas, the Company cannot guarantee the consistency and stability of the pocket wifi or related devises.

7. Cancellation of order

Customer should inform the Company immediately for any cancellation of the contract or order.

With more than 5 days prior to the Departure Date, 30% rental fee will be deducted and the Deposit will be fully refunded.

Within 5 days prior to the Departure Date, 50% rental fee will be deducted and the Deposit will be fully refunded.

8. Theft, Loss, Damage and data overused    

A.  The Customer agrees to use the Equipment in a careful and proper manner in accordance with the instructions of the User Guide.

B.  In the event that the Equipment is lost, damaged, being stolen or missing, Customer needs to notify pocketwifi.com.hk immediately either by phone (852-28927657) or by email (support@pocketwifi.com.hk). The Customer is liable for all charges due to the context incidents of the Equipment until it is deactivated by the cellular carrier of the designated destination.

C.  If the Equipment is found to be damaged after its returning to the Company, the Company will conduct an inspection on the Equipment in the presence of the Customer to determine the cause of the problem in order to avoid future controversy.

D.  The following fees are imposed for the damaged or lost items:

The above plenty is subject to be changed without further notification.

In the event that the Equipment is lost, damaged, being stolen or cannot return it on time, the Company has the rights to deduct the deposit/down payment as compensation.

Also, deposit/down payment will be deducted for cases that overused data in those limited data provided countries. The Company will impose additional charges in separate invoice if the amount of exceeded data goes beyond the deposit/down payment.

The calculation of data overused is as shown below:

*The unit of daily data limit is an integer. For instance, if the daily limit is 300MB, a 450MB data overused will be considered 600MB in the overused calculation. That is 300MB x 2 units.

9. Prohibitions

A.  The User shall not be installed in the Internet devices other mechanical or accessories, and shall not engage in transformation, decomposition, damage, change the setting, or other changes to the Company Equipment which would result in the malfunctioning of the Equipment.

B.  The User shall not engage in communications Equipment sublease, transfer or pledge in the third person which results in the damage against the Companies ownership.

C.  The User shall not use the Company's Internet device for any irregularities or illegal acts.

10. Fair Use Policy

A.  In some countries, a Fair Use Policy may be in place in accordance with the business practices of the local internet service provider (the local in-country wireless network carrier or operator). If a FUP is in place, it may limit the transfer of a specific amount of data over a period of time. Internet service providers commonly apply a cap on the amount of wireless data when an individual user has exceeded a certain amount of data within a specified time period, which can result in a throttle down (slow down) of the connection speed without prior notice and compensation.

B.  Service suspension may apply if user downloads continuously or if your use impacts other users. No refund or discount will be given if the above matter occurred.

11. Disclaimer

A.  Mobile data of the smartphone should be turn off before you go to the designated country. You only have to turn on the Wi-Fi function of your smartphone and connect to the pocket Wi-Fi to obtain the wireless data once you are in the designated country. The Company cannot be held responsible for the overseas roaming charges imposed by the service provider in the event the Customer unintentionally turns on the roaming mobile data service.

B.  If the Customer encounters any difficulty in using the Service while at his/her destination, the Customer must notify pocketwifi.com.hk immediately within the Rental Period in order to qualify for any possible refund or discount to the Charge.

C.  If there is a change of destination and notice is not conveyed to the Company, the Company will not be held responsible for the proper working and function of the Equipment being handed over to the Customer.

D.  The Company will be in no event liable for, nor shall the Customer make any claim against pocketwifi.com.hk, any liability, claim, loss, injury, damage or expense of any kinds (including lost profits), whether direct, indirect, incidental or consequential caused by the Equipment or the failure of the Equipment to operate correctly or not, or for any delay, faultiness (such as degradation of service) or failure of the services.

E.  In the event of malfunction of the Customer's smartphone, the Company will not be held responsible for its working and rental charges still apply.

F.  The Company takes no responsibility if the user through inappropriate, careless use or misplaced the Internet devices leading to short-circuit or fire, which causes any casualties and losses to the user as a result, the Company advises the user to pay attention and use the device with care.

12. Miscellaneous

Unless raising any opposition by the Customer, UC Exchange Co. Ltd./Pocketwifi.com.hk may publicly disclose that we are providing Services to you and may use your name and logo to identify you as our customer in promotional materials, client reference and press releases.

We reserve the right to discontinue our rental services or terminate and/or amend this Rental Agreement at any time at our sole discretion. Expiration or termination of this Rental Agreement will not relieve you of any payment obligations hereunder.
